Please can anybody advise, how long do you have to be away from a company to have broken service. say for instance you work for a company for five years and resign. from the day you leave they ask you back (so you take a weeks leave) restart on a temporay basis for two months and then get re-employed, is this broken service if you have still been on the payroll in all this time?

There is not time required by law. If the retrenchment was properly effected and the employment was properly terminated then the service was broken, regardless of how long you left their service.

If you leave a company, resign and then go back in 4 months same year, do you get the same benefits when returning or start as a new employee
