Please tell me if it is legal for your employee to give you a contract for 195 hours a month, if you can only work 45 hours a week and comes to 180 hours a month? Anything worked more than 45 hours should be as overtime and they dont ask you to work overtime. They just say that you are scheduled to work as it states in your contract?
An employee may only be required to work for 45 hours per week, excluding overtime. Anything beyond 9 hours per day is considered overtime, if you work 5 days a week. Because there are roughly 4.3-4.5 weeks in a month, that figure was used to calculate your overall working hours per month. Hence, 45 hours a week for 4.3 weeks, or 196 hours throughout the month.
