Hello, I joined a plumbing company in August last year, we have a verbal contract on remuneration and the employer was supposed to draw up a contract but never has and hasn't been paying me as we agreed, he is using my qualifications and certificates to run his business, I spoke to him in December about this and he asked me how we can resolve this and we agreed on a settlement but he never lived up to it, please help
Contrary to popular belief, you do not have to sign a written contract for an employment contract to exist. However, you are entitled to have the particulars of your employment in writing. Ask your employer for this, so that there can be no confusion as to what your responsibilities and rights are.
If your employer refuses to do so, you can take it up with the Department of Labour.
