Good day I was hoping you could offer me some advice. I started working at my current company in March 2012. Since then I have never taken annual leave. Only took of when my son (turning 2 years in November) was ill and I provided a doctors letter for each time. As at 30 September 2013 I had 15 leave days. My son (I am a single mom) is at a creche which closes on 13 December and opens 6 January. My mother is going away on 23 December and returning 6 January. I have no one to babysit. I filled in my leave form for 23 December returning to work 6 January but my supervisor didn't approve it stating that she will be on leave the week starting 30 December and my other colleague in our department will be on leave the week after that. I asked her whether it would be necessary for 2 people to be on duty as the business will be quiet. She told me to try and make alternative arrangements and rather take leave from 6 January. I spoke to my mom to ask her if she can't cancel her holiday. My mom told me that she can't and that the law says I have the right to be with my son during his holiday. I googled it and discovered this: "Your paid holidays should be allowed to coincide with the holidays of school going children. According to the Basic Conditions of Employment Act every employer must regulate the working time of each employee with due regard to their family responsibilities." http://m.mywage.co.za/main/decent-work/nationalregulations%20/national-south-african-regulations-on-decent-work Please explain to me what the above means and whether it is valid in my situation. Annual leave is different to working hours. When you take your leave is ultimately at the discretion of the employer. The only time this changes is if you have not taken it in 18 months, then you have the right to demand.
