Company/Finance Manager to deduct money for their ignorance

Hi

 

I am working for a company that gives me the benefit of a company vehicle, of which I pay a company perk tax, understandably, as agreed when signing my contract.

However, my finance manager has called me in today to tell me that the company/finance manager has not been deducting the perk tax off my salary for the last 7 months during my employment, which is the amount of R11500 and that I am now liable to pay this money back??

 

The finance manager says that I should have said something if I noticed that it wasn’t on my payslip??? (Isn’t that his job to know this, as he pays m salary??) It says nowhere in my contract that I should be aware of this tax coming off my salary on my payslip?

I was never aware that I wasn’t being taxed in the first place, as I work in the sales department and not in HR, as I had assumed the tax was being deducted already?

The company/finance manager is also telling me that they are going to put the R11500 on the payslip as a loan to me from the company, and that I have to sign an AOD with a maximum term of 12 months to pay this amount back, which will be just under R1000 p/month.

 

So going forward the finance manager is telling me that I will now be paying company perk tax from the end of this month +- R1000, as well as paying the additional R1000 on top of that, which I will never be able to afford, as I am barely getting by at the moment.

 

I am not sure where I stand in this situation as it was not my fault that they had not been deducting the money?

And if I am liable to pay this back, surely they should allow me to pay it back over a longer term?

 

I will appreciate all the advice and help.

In terms of the Basic Conditions of Employment Act, an employer may make no deductions from your salary unless you have agreed to it in writing and never any deductions exceeding 25% of your salary.
