My union representative secretly agreed with employer and the Bargaining Council to decide my unfair dismissal case without a formal arbitration hearing. Before their so called pre -arbitration meeting(i was not informed about this meeting), i instructed an attorney to represent me at the Arbitration hearing. My attorney wrote a letter to the Bargaining Council informing them about his instruction to represent me at the Arbitration hearing, and requested the secretary of the Council to send the notice of the hearing(Set down) directly to him(my attorney). The Bargaining council ignored the letter and my case was decided without a formal hearing where i would have been given a chance to produce my evidence, call witnesses, cross examine employer,s witnesses and peruse documents submitted by employer.I am accused of doing things i did not do. They did not submit any evidence at the disciplinary hearing. They ignored my request to appoint an investigator to probe the allegations.It is just a witchhunt.They want to get rid of me. I was surprised to receive an award from the Commissioner confirming my dismissal. Is it fair. Please advise me.
