A couple of months ago I was off ill. Notified my manager by sms & she received it (Friday). Monday I Notified her again by sms which she also received and replied to. 3rd day (3rd sms) apparently she has not received. 4th sms received and responded. On my return she called me in and told me that she will not accept any sms's from me again. I have not agreed to it due to this was the first incident and not fair because the other team members are still notify her by sms?
Last week I was off ill again which I then sms her of my sickness and she responded. 3rd day I notified her that I will be of for the remainder of the week.
on my return my manager issued me with a written warning not notifying her of my return & of notifying her by sms. I have not sign the document.
To the above I refer you to a recent amendment to the Employment Equity Act which reads as follows:
Section 6 Prohibition of unfair discrimination
(1) No person may unfairly discriminate, directly or indirectly, against an employee, in any employment policy or practice, on one or more grounds, including race, gender, sex, pregnancy, marital status, family responsibility, ethnic or social origin, colour, sexual orientation, age, disability, religion, HIV status, conscience, belief, political opinion, culture, language, birth or on any other arbitrary ground.
