I work for a big mining company. I was the first woman to run operations department and have been running it since Jan  2015. Last year we had a very successful production year. My boss then resigned in Dec 2015 and left. In Jan I got a new boss. In one of the first meeting he had with me, he told me this is a man's world and asked if I will survive, and I told him that I will survive, have survived so far. 

Then my section started having some maintenance issues that have affected production, my maintanance colleague was handling the issues that we were having. My boss called me in his office and told me that I cannot lead, I told him that we have some equipment issues and as soon as those are sorted out we will improve on production. 

He later decided to relieve me of my duties and let the maintenance colleague to run both operations and maintenance. He said he is doing that for my wellbeing and give me a chance to balance work home relationship. He said he will create a role for me elsewhere on the mine. Thinking about this I feel that I have been discriminated because I'm a woman, and I would like to take this further. The section that I was running is known to be challenging, and always when the males are running it they get more than enough support from the business. When I had the challenges and needed the same support that is given to the males I was told that I must make sure that we sort out the challenges on my own, even though most challenges were equipment related. Now that they put a male back there, we are having all sort of consultants coming to assist.

There was never a performance discussion nor performance improvement plan.  The area that gave most challenges was maintenance KPA.  My last three performance rating was good.  When he relived me from my duties he was with an HR boss,  he then told me that since I have 2 cars I will use one of my car as an office.

What I did afterwards I went to see the HR boss and told him what had been happening  and also told him about the comment of me using my car as an office.  That day I sat there and watched men laughing I didn't get the joke.  The HR boss said he took that as a joke and thought that's how we engaged.  When I asked the HR boss why didn't I have a poor performance discussion,  he said they don't always do things by the book.

This is indeed a potential unfair labour practice. Perhaps see an attorney to get assistance in referring the matter to the CCMA. You can also approach the CCMA yourself if you would prefer to do so.
