My son started working for company A in Jan 2014.

 

Company was subsequently sold to B in September 2015.

 

A new employment contract was given to him stating 2 weeks notice if employed less than a year.

 

He has been with company B since their take over for a period of 2 days short of a year.

 

They insist he must work 1 month notice.

 

 

 

 Are they legally correct as they are threatening to with hold his leave pay of 17 days.?

His service is continuous regardless of the sale of the business. He has therefore worked for more than a year and should comply with the contract in respect of the full month notice period.

 

They are legally obliged to pay out his leave on termination of the employment relationship - no leave can be taken during the notice period.
