Greetings would like some advise on my situation. my employer employed me on the 1 March 2016 on a fixed term contract for ten months expiring 31 December 2016 during October 2016 a memo was prepared by my supervisor requesting approval for contract renewal this was subsequently approved by management however in January 2017 my employer informed me the company does not have a budget in which they can pay me from and therefore i am released from my employment. this happens three days after the company called all employees and assured them that all contract workers are to be converted into permanent positions before the 1st f July 2017.
i have since opened a case against my employer and would like to find out if it makes sense for me to request to be permanently employed and a back-pay of my salary effective 1st January 2017.I have done a bit of checking into SA labour law and mainly section 186(B) of the LRA prompts me to believe reasonable expectation has been created for renewal due to a signed document which i have a copy of as well as the fixed term employees amendment as have been employed for a period longer than three months.
