Good morning Sir / madam

 

I am actually working in a vacant permanent post on a contract basis. I am on my 2nd contract right now(new contract is what I jut found out last week with labour broker is a semi-permanent contract which I don't understand). In what I believe according to the law, an employer is not supposed to keep someone on contracts in what is actually a permanent post. I have long passed the probation period of 3-9 months...I am actually doing more than the permanent staff, and manager and all peers know and accept that I am an excellent employee. My workload is almost double that than of the other finance clerks(who are permanent) who works in tandem with me to complete all finance work given to us. I have 2 parents who are pensioners and I have a ministry of helping people in christ. I need and trusted manager to give permanent post, but he has had 4 different excuses as to my wait 4 permanent, ie:

 

A) for over 1 year when I asked when I'm gonna be permanent he used to tell me "must wait I will be permanent"

 

B) after that we had new owners and he used to say that place might close down anytime and no staff is safe, but they are employing temps and perm staff regularly at present

 

C) then I found out that acting manager and h.r had a meeting about me and came to conclusion that I will not be getting position as a person of certain colour (I only found out about this meeting when I asked h.r about my position-otherwise it would still be unknown to me).

I also called a meeting with labour broker and management recently and found out that manager and acting manager had meeting some time ago about me and my position, Why did noone tell me about all this? Not fair

 

D) then last week I found out that my position is not gonna be safe because another brewery in another province is closing down and staff might or should be moved here and my position is up for them. 2 - secondly I believe that I am being given contracts so as not to receive the actual pay I deserve if I were permanent (which I should be by the allowed probation period passing). I was wondering if I can claim back-pay to what I deserve. PLEASE HELP !!! Me and my family are desperate, I love this job and people there. But I also believe YOU can help me now rather than when/if I'm dismissed(which I don't actually deserve for occupying post for 2 years).

I have also been told recently by an employee who is close to the big boss here that even if I win case, the boss can get me out within 6 months legally by saying that I'm surplus or company is doing bad!

 

That is giving me 2nd thoughts about taking this up with ccma...

 

I really need your help/advice (I have so much of written proof also, written whenever I had meetings or experienced them)

Good Afternoon 

I kindly ask for more information on the following:

1) Who pays your salary/wage. It is important to identify who pays your salary in order to identify what type of employment relationship exists between you and an employer. 

2) On what basis will the contract expire, upon completion of a certain project, the occurrence of a specific event or fixed until a certain date.  

In reality there is nothing stopping an employer from dismissing his employees. The law provides employees ways to remedy unfair dismissals by way of the CCMA and the Labour Court. I would advise if you feel strongly about the way you are being treated in the work place then you should seek the advise of an attorney and they can proceed further.
