Greetings 

I tendered my resignation on 16 February 2016 - my last day being 15 March 2016[ Today ]. 

I tendered my resignation verbally in person to our Shareholders on this date [ 16 Feb ] I had a signed letter of resignation for my CEO as she was on leave during this time.

Upon her return she confirmed my resignation in writing on an unsigned letter of resignation dated 13 February , making my last day 10 March.  During my official handover on 08 March she insisted that it was the 10 of March citing reasons that I was not working at that time and that my last working day would be 10 March. I made a concession as to avoid horse trading for working days of salary which equates to R 6200 for the 3 days and confirmed my willingness to this concession. 

I enquired on 14 March with our CEO with regards to my final payment as it would be a pro rata salary as well as 30 days accrued leave and I was advised that it would only be settled on the 25th of March with the payroll run. I politely reminded them that essentially our contract of employment ended on my last day ( not disputed at this stage ) and according to the BCEA all outstanding payments to me had be made within 7 days of the end of that contract. Our company accountant replied with the reason for the payment on the 25th being that the tax tables for the new 2017/2018 year had not yet been updated on our accounting system and a consultant was only available to do this on the 23rd. 

I do feel there is advantage being taken here as I believe this is not a valid excuse to delay paying my final salary and leave as well as taking advantage of the shortened period with regards to my notice , I made the concessions to just get on with my life as I start a new postion on 1 May. 

What options do I have with regards to this matter ?
