Drop in Salary for changing jobs
Permalink

In 2016 i was told that my job in the company was redundant and i had to move into another position with immediate effect. The new job was a lateral move hence no salary increase. This year 2017 i find out that the company is planning on employing somebody for the same position that was made redundant. When i approached management about t his i was told i must apply for the job but i must be prepared to take a drop in salary should i be offered the post. I would like to know what are my rights in this matter.

Good day

It would be in your best interest to seek legal advice, these matters could get extremely complicated.

Kind regards

Please advise on a question I have - it is similar to the previous question.

In 2011 I was offered a fixed term contract after resigning from a company due to many growth/scope concerns.
The contract was a basic 5-year term contract as is usually offered in the field I am working in. In 2013 a staff member under me resigned and in stead of filling the position, I was asked if I would be interested to take the duties on for extra remuneration. I was open to this and asked for 50% of the CTC of the person's package who resigned. In the end, the negotiations agreed to a third (33%) of the CTC.
Due to this a new fixed term contract for 5 years was drafted and signed. This contract is expiring in December 2017.

Late in 2013 there was a management change and I was removed from the position I held and "seconded" to an another department. I did not object to this as the change in management was something I wasn't acclimatising to. Since having moved in late 2013 the department I have been in has received many outstanding performance evaluations (quarterly and annual perfomance reviews) Of which we have been the top performing section in the entire organisation of more than 700 employees. Recently again for the past financial year, the section only got above average ratings and it has openly been noted this could not have happened without my efforts. Ratings are 4 and 5 out of 5 for all KPI's usually.

The issue, however, is that I have been advised that my contract will not be renewed and that the best they can do is a permanent position at roughly 60% less remuneration. My question also relates to a recent case where contract employees after a certain period become permanent. Is this the case and would that be applicable to my situation? Please also note that after I was moved in 2013 they appointed another indivitual almost immidiatly for roughly 30K p/annum more. They also filled the post that was under me where I got 33% of the CTC linked into my current contract.

Basically, I would like to know if I can fight for a renewal, do I have a leg to stand on?

If you could point me in the right direction where I may get a legal opinion that would also be appreciated.

Regards
