Good afternoon

 

I need some clarification regarding a Notice in terms of section 189A (Mass retrenchments) issued to all of us.

Our Employer is currently considering restructuring its organization in an attempt to better streamline it Organizational Structure.  Stated in the notice "The Employer has come to the conclusion that certain positions within the Employer may have become superfluous to the operational needs and requirements of the Employer, due to duplication of services rendered in certain positions and that such needs could possibly be better attended to by combining and/or centralising such positions and functions".

Further they say "The reason why restructuring is considered is an attempt to streamline the organization ad to simplify the operating structures an reporting lines in the Employer and in so doing to help the Employer to stay competitive in the market and to optimize its performance through the centralization of its management structure, to prevent a duplication of services. For that reason the Employer is considering the restructuring of its organization.

I am currently the only employee Employed to do the Tendering, no-one else currently can do my job. My question is, will this apply to me as well or will it only apply to duplication service/positions currently in the company?

The selection criteria also states " In light of the new centralised Management structure certain positions are in effect duplicated within the Group, which is not financially and/or structurally viable which thus the core of the rationalization process."
