Good day

A warning may be issued at any time the companies polices have been breached. A verbal warning stands for 3 months, written warning stands for 6 months and a final written warning stands for 12 months. A warning is used as a tool by the employer to note your failure to comply with company procedures in your record. The employer should use the warning as a form of education and bring your back inline while offering you a chance to change your behavior.

It must be noted that you cannot dismiss someone fairly based on issuing a series of warnings. A disciplinary hearing must take place. The conduct by your employer had been unfair, you have 30 days to refer the matter to the CCMA.

Regards LP

Hi I am in a similar situation, similar dates even for receiving the warnings... Although six months have passed since my first written warning. I have now received three warnings all on the same day, having been back dated, including two final written warnings & have been given a date for a disciplinary hearing. Is it legal to back date warnings, without any mention of them? Is there not a legal time frame in which an employer has to issue a warning from the time of the incident? I was asked to put in a request for set weekly shifts, days & times... After doing so my shifts were issued & I had worked the same days & times each week. Until one of the dates for which a warning was back dated & issued as a result of my being late for a shift that started 2 hours earlier than I usually started work each Thursday, without prior warning to my shift times changing... Would I be able to appeal against a final written warning for this reason in my hearing? Any advice would be appreciated!!! Thanks
