I was employed on a 6 month fixed term contract, which expired on 31 October 2015. My employer refused to pay out my leave that I am entitled to in terms of the BCEA (1,25 days per month). Their argument is "use it or loose it".

I earned a salary of R 201,600 for the period (R 33,600) per month. Am I covered by the act regarding this, i.e. can the Department of Labour  enforce an order to pay?

From what I understand the employer MUST pay. Furthermore the Department of Labour has the authority to make your employer pay.
