Hi,

Can someone please assist in regulation around hospitality industry and overtime

I work in hospitality and the business run 24hour 7 days a week.

We are shifted 5 or 6 days a week, with off days inbetween, but off days are not on weekend or necessarily at night.

so the shift could be 7am - 3pm, or 3pm - 11pm

and my off days could be mid- week

if I work on a public holiday or weekend or late shift, do I qualify for overtime?

Also how does leave accrue if I work 6 shifts on?

On face value, it appears that you could be entitled to receive Sunday and public holiday adjustments. Note that the latter two are at 2 times the ordinary hours salary, although if you do work Sundays ordinarily, it will only be at 1.5 times the ordinary amount.

 

Furthermore, the time of day at which you work is not an indication of whether it is overtime. If you do work the night shift, however, you are entitled to a night shift allowance.
