Hi. I recently received the disciplinary enquiry letter which stipulated that I rendered a misconduct in the sense that I did not report to work and a refusal to obey reasonable instruction from senior. Prior to receiving the enquiry letter, there had been unilateral change on the terms and conditions of employment. The senior demanded a change in a way that we report to the office. As such, based on my understanding of Basic Conditions of Employment Act as well as the contract of employment, the employer is required to consult and engage with employees when such changes to the terms and conditions of employment prevail. In this case, the employer did not engage and never consulted. Instead the senior demanded and harshly enforced that all employees to start reporting in a manner that is not procedural and fair. Furthermore, this is only applicable to a group of employees and not the entire staff nationwide. The demand to report evolved from the fact that certain individuals did not report to the senior for late coming and thus this affected the whole team. I am afraid of challenging the employer without a representative. However, I subscribe to a particular law firm. Please help.
