if I received a termination letter from my employer dated the 31 October 2016 and the letter says my services are terminated from the 01 November 2016.Can I still send the employer the Ccma form on the 01 December 2016 to be considered for arbitration .I see that they must get the form and proof within 30 days .Can the letter be emailed to the person as proof of receipt on the 01 December 2016

Good day,

If your referral to the CCMA is late then there is an option available to those that have a valid reason as to the lateness. This remedy is known as a condonation application.

furthermore the referral forms are very clear as to the way in which the documents have to be served. In terms of form 7.11, the documents are to be served in one of the following ways

1)registered mail

2)hand delivered, remember the document has to be signed therefore i would advise that if you use this option that you take at least two copies with and make them sign your copy.

3)statement from the person that delivered the document, though this is an option i would advise against.

4)FAX

5)email

6) any other means that could possibly serve as proof that they have received the documents.

the more preferable choice would be fax as the fax number of your employer would be easy to obtain.

furthermore note that if you have difficulty with service the CCMA is available to assist (as stated in the Form 7.11).
