Good Day. My company has advised that I will be returning to work shortly at level four but requires me to sign an indemnity form. I am 56 years old with hypertension and on chronic medication. Is this requirement legal and what rights would I be giving up?

Good day, 

If your employer is seen as an essential business and can return to work during level 4 regulations then you should report to duty.

Your employment contract becomes possible to fulfill as long as the employer complies with the safety regulations then there should be no problem with you returning to work. In terms of the indemnity this is something that cannot protect the company from a civil claim it will have to be placed in the courts hands. Remember that due to legislation if you become injured on duty you can have a workmans compensation claim. 

This extends to the COVID-19 pandemic. 

If you refuse to go to work then you will be conducting an act of insubordination and absconding.
