I have been dismissed at work because I borrowed money from some work colleges. My boss ask me if I had borrowed money from any colleges and I said no.. My boss then had secret meetings with staff reporting to me and they admitted that we had borrowed money between each other and that it was on a personal basis. I got dismissed for gross dishonesty, I was uncomfortable in disclosing this to my boss and I felt that it had I impact on the business. Do I have merits to appeal this at the ccma
Yes You do as that was a personal matter and not unless there is a written policy within Your workplace that is prohibiting You to borrow money from Yours Colleagues and You may have been aware of it
What has essentially happened is that you where dismissed for misconduct.
Now in order to have been dismissed for misconduct you have to have breached a rule of the workplace either a written rule or a general rule that is universally accepted as being misconduct for example late coming or stealing.
If borrowing money is not specifically covered in the employment policy then you may have a chance however the issue that I see was that you where not dismissed for borrowing or lending money but for lying to your boss. This is an accepted form of misconduct and it is likely that a commissioner hearing the matter at the CCMA would find that the lie itself was a serious breach of conduct.
The choice to refer the matter is ultimately yours however I am not confident as to your prospects of success.
