I employed 2 new staff members end of last year (2020) to start 7 January 2021.

Due to Covid my industry has still been put on hold and we can not work as of Friday the 18th of January.

By middle of February (🙏🏻🙏🏻🙏🏻) we should be able to start up.

We have not earned an income how do I pay salaries if no income eared.

How or what is the procedure if I can't pay them due to schools being shut again and it's their 1st 2 weeks with me.

 

So basically they have only worked 6 days. But we will need to close till 15 feb

While an employer does have an obligation to pay salaries this obligation must be balanced with the reality of the situation.

If you cannot afford to pay them their full salaries then I would suggest perhaps a reduced salary if possible. Remember to sit down and discuss this with the employees beforehand just to be safe.

Unfortunately as I understand it the TERS has ended so that cannot be claimed from.

There is always the option of retrenchment if you cannot afford to pay them, there is no limit in terms of when an individual can be retrenched however you will still need to follow the procedure set out in section 189 of the Labour Relations Act. Retrenchment might be a bit premature as it sounds as though your situation could still change.
