I am wanting to find out if an employer whose head office is in Gauteng can hold a disciplinary hearing in Gauteng, for an employee who is suspended from their Durban branch and resides in Durban? Any advice would be appreciated. Thanks
I would advise that they hold the disciplinary in Durban or at the very least make an effort to allow the employee to be able to make representation, which is to put their side forward. If the employee is not give a fair and reasonable opportunity then the employer may very well have big problems at the forum to which the matter will be deferred.
