I have worked my 4 weeks notice period, today being my last day. When enquiring on my last salary and leave pay payment date I was told 24/12/2019. Am I wrong in thinking law stipulates within 7 working days? How do I go about resolving this issue?

Good day,

You are correct with regard to the 7 days. in terms of Section 32(3) of the Basic Conditions of Employment Act, as amended, you have the right to receive payment no later than 7 days.

However, I believe that the only available avenues to resolve your dispute would be the, Department of Labour, CCMA or ordinary civil litigation.

The problem with the above is that it would take much longer than actually waiting till the 24th.

I would therefore advise that you wait till the 24th and should you not receive what is due, you should then either approach the nearest Department of Labour, which is free, or alternatively consult an attorney which would be more costly.
