Good day

I have a labour related inquiry.

on 01-01-2021 i informed my employer that i have been in-contact with covid-19 positive family member (My Dad)

The employer then advised on the 3rd that i should go into isolation.

My Manager asked if i had had any discussion with HR regarding leave etc. i then informed her that HR did not discuss anything they simply said i should isolate, she then said she will discuss with HR and provide feedback to me. - this did not happen.

no form of options regarding to remote work was discussed either and no discussion about operational requirements was had between myself and line manager as committed to by Manager.

, on 18-01-2021 i then came back to work and inquired with HR regarding my leave as i had noticed that Unpaid leave was processed. My dispute is that nothing was discussed with and no options were given to me regarding working remote or unpaid leave if i dont, but yet they processed unpaid leave on the basis that i did not work from home, whereas i was still awaiting feedback from my manager to discuss a way forward.

please can i get advise as now this will mean i will be paid half my salary, can they do this?

This does sound like a very unfair situation.

Unpaid leave is usually taken only when an employee has used up his or her paid leave.

I believe that this matter can be referred to the CCMA as an unfair labour practice as it does involve a benefit or alternatively to the Department of Labour as a violation of the Basic Conditions of Employment Act.
